These Terms of Service ("Terms") govern your use of tog-gems.com (the "Site"), operated by TOG-Gems LLC ("we," "us," or "our"). By using the Site, you agree to these Terms.

Nature of the Site

tog-gems.com is a catalog and inquiry platform for viewing available gemstones offered by TOG-Gems. Browsing the Site does not constitute a purchase. All sales are arranged directly with TOG-Gems following an inquiry, and are subject to availability, mutual agreement on price, and confirmation by TOG-Gems.

Product Descriptions

We make every effort to describe and photograph each gemstone accurately, including weight, dimensions, color, clarity, treatment status, and certification details where available. However:

• Natural gemstones are unique, and minor variations in color and appearance may occur between photographs, video, and the physical stone due to lighting and display settings.
• Where a third-party grading report (e.g., GIA or another laboratory) is referenced, that report is issued and warranted solely by the issuing laboratory, not by TOG-Gems.
• Prices are subject to change without notice and are not final until confirmed in writing by TOG-Gems.

Availability

Because our inventory consists of one-of-a-kind natural gemstones, a stone shown as available on the Site may be sold or otherwise unavailable by the time you inquire. We will notify you promptly if this is the case.

Intellectual Property

All text, photographs, and video on the Site are the property of TOG-Gems unless otherwise noted, and may not be copied, reproduced, or used for commercial purposes without our prior written permission.

Limitation of Liability

The Site and its content are provided "as is." To the fullest extent permitted by law, TOG-Gems disclaims liability for any indirect, incidental, or consequential damages arising from your use of the Site. Nothing in these Terms limits any warranty or right expressly provided in a signed sales agreement between you and TOG-Gems for a specific gemstone purchase.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
